Welcome to Matt Vaught Tattoo LLC. These Terms of Use ("Terms") govern your use of our website at mattvaught.com and your relationship with us when you book and receive tattoo services. By using our website or services, you agree to be bound by these Terms.

IMPORTANT: Please read these Terms carefully before using our services. If you do not agree to these Terms, you may not use our website or services.

1. Acceptance of Terms

By accessing our website, submitting an inquiry form, booking an appointment, or receiving our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are booking services on behalf of another person, you represent that you have the authority to bind that person to these Terms.

2. Eligibility and Age Requirements

AGE REQUIREMENT: 18+ ONLY
Our services are available only to individuals who are 18 years of age or older. By using our services, you represent and warrant that you are at least 18 years old. We require valid government-issued photo identification to verify your age before providing any tattoo services.

We do not provide services to minors under any circumstances, even with parental consent. If we discover that a minor has provided false information to obtain services, we will immediately terminate the appointment and the deposit will be forfeited.

3. Services Provided

Matt Vaught Tattoo LLC provides professional tattoo services, including but not limited to:

  • Custom tattoo design and application

  • Consultation services

  • Tattoo touch-ups and cover-ups

  • Services at our Los Alamitos studio location

  • Services at conventions and guest spot locations

All services are subject to availability and at the sole discretion of the artist.

4. Booking and Consultation Process

4.1 Initial Inquiry

Clients may submit an appointment inquiry through our website contact forms, providing:

  • Basic contact information (name, email, phone number)

  • Tattoo design request and details

  • Reference photos of desired design

  • Photos of the body area where the tattoo will be placed

  • Preferred location (studio or convention)

4.2 Consultation

Following your inquiry, we will conduct a consultation to discuss your tattoo design, placement, sizing, pricing, and timeline. During the consultation, we will:

  • Review your design ideas and provide professional recommendations

  • Discuss pricing based on size, complexity, and estimated time

  • Establish a session rate for your tattoo project

  • Answer any questions about the process, aftercare, and healing

4.3 Moving to Appointment Booking

Once we complete the consultation and mutually agree upon the design, pricing, and terms, we will move forward with appointment booking, which requires a deposit.

5. Deposit Policy

NON-REFUNDABLE DEPOSIT REQUIRED
Once we complete the consultation and move to appointment booking, a non-refundable deposit of 50% of the agreed-upon session rate is required to secure your appointment.

5.1 Deposit Requirements

  • The deposit covers 50% of the total session rate agreed upon during consultation

  • The deposit is non-refundable under all circumstances

  • The deposit is applied toward your final session payment

  • Your appointment is not confirmed until the deposit is received

5.2 What the Deposit Covers

Your deposit reserves your appointment time and compensates for:

  • Time blocked off exclusively for your session

  • Custom design work and preparation

  • Materials and supplies ordered specifically for your project

  • Administrative costs associated with booking

6. Cancellation and Rescheduling Policy

6.1 Rescheduling with Advance Notice (72+ Hours)

If you need to reschedule your appointment:

  • You must provide at least 72 hours advance notice

  • Contact us via phone, text, or email to request a reschedule

  • Your deposit will be applied to your new appointment date

  • No additional penalties will be charged

  • We will work with you to find a mutually convenient new appointment time

6.2 Rescheduling Without Adequate Notice (Under 72 Hours)

If you reschedule with less than 72 hours notice:

  • You may be charged up to the full value of your deposit as a penalty

  • The penalty amount will be determined based on circumstances and timing

  • You may be required to provide an additional deposit to secure a new appointment

6.3 No-Call, No-Show

If you fail to appear for your scheduled appointment without prior notice:

  • Your full deposit is immediately forfeited

  • No portion of the deposit will be applied to future appointments

  • A new full deposit will be required to book any future appointments

6.4 Cancellations Without Rescheduling

If you cancel your appointment without rescheduling:

  • Your full deposit is forfeited

  • No refund or credit will be provided

  • A new deposit will be required if you decide to book in the future

6.5 Artist-Initiated Cancellations

In the rare event that we must cancel or reschedule your appointment due to illness, emergency, or unforeseen circumstances:

  • We will notify you as soon as possible

  • Your deposit will remain valid and be applied to your rescheduled appointment

  • Alternatively, you may request a full refund of your deposit

7. Payment Terms

7.1 Accepted Payment Methods

We accept the following payment methods:

  • No Additional Fee: Cash, Venmo, Zelle

  • Processing Fee Applies: PayPal, Cash App, Square (credit/debit cards)

Processing fees for credit cards and certain payment platforms will be added to your total. The exact fee percentage will be disclosed before payment processing.

7.2 Payment Schedule

  • Deposit: 50% of session rate due at time of booking

  • Balance: Remaining 50% due at the completion of your tattoo session

  • For multi-session projects, payment terms will be discussed and agreed upon during consultation

7.3 Pricing

  • All pricing is established during the consultation phase

  • Session rates are based on the size, complexity, placement, and estimated time required

  • Prices quoted are estimates and may be adjusted if the scope of work changes significantly

  • Additional sessions beyond the initial estimate will be priced separately

8. Refund Policy

NO REFUNDS
All sales are final. We do not offer refunds for any services, deposits, or payments once rendered. This includes but is not limited to dissatisfaction with the final result, changes of mind, or personal circumstances.

By booking an appointment and providing a deposit, you acknowledge and agree to our no-refund policy.

9. Health, Safety, and Consent

9.1 Health Disclosure Requirements

Prior to receiving services, you must complete our health and consent waiver form, which includes disclosure of:

  • Medical conditions and health history

  • Allergies (especially to latex, inks, or topical anesthetics)

  • Current medications

  • Skin conditions or sensitivities

  • Recent illnesses or infections

  • Pregnancy or nursing status

  • History of keloid scarring

  • Blood-borne diseases or immune system disorders

You agree to provide accurate and complete health information. Failure to disclose relevant health information may result in injury, complications, or unsatisfactory results, for which we will not be held liable.

9.2 Medical Disclaimer

We are not medical professionals. If you have any medical concerns or conditions that may affect your ability to receive a tattoo safely, you must consult with a licensed physician before booking services. We reserve the right to refuse services to anyone with contraindications or health concerns.

9.3 Contraindications

You may not be eligible for tattoo services if you:

  • Are under the influence of alcohol or drugs

  • Are pregnant or nursing

  • Have certain skin conditions, infections, or open wounds in the area to be tattooed

  • Have certain medical conditions that impair healing or increase infection risk

  • Are taking blood thinners or other medications that may affect the procedure

  • Have had recent sun exposure, sunburn, or tanning in the area to be tattooed

We reserve the right to refuse services at our sole discretion if we believe the procedure would be unsafe or inadvisable.

9.4 Informed Consent

By receiving our services, you acknowledge and consent to the following:

  • Tattoos are permanent and involve the injection of ink into the skin

  • The procedure involves pain, discomfort, and potential risks including infection, allergic reactions, scarring, and unsatisfactory aesthetic results

  • Healing time varies and proper aftercare is essential

  • Touch-ups may be necessary and are not included in the initial price

  • Results may vary from the design mockup due to skin texture, placement, and individual healing

  • You have been given the opportunity to ask questions and receive answers

  • You voluntarily assume all risks associated with receiving a tattoo

10. Aftercare Responsibilities

Proper aftercare is critical to the healing and appearance of your tattoo. Upon completion of your tattoo, we will provide you with detailed aftercare instructions via text message and/or printed materials. Your responsibilities include:

  • Following all aftercare instructions carefully

  • Keeping the tattoo clean and moisturized as directed

  • Avoiding sun exposure, swimming, and soaking the tattoo during healing

  • Not picking, scratching, or disturbing the healing tattoo

  • Contacting us immediately if you notice signs of infection or complications

  • Attending any recommended follow-up appointments

Failure to follow aftercare instructions may result in infection, poor healing, color loss, or other complications. We are not responsible for results affected by improper aftercare.

11. Intellectual Property

11.1 Custom Designs

All custom tattoo designs created by Matt Vaught Tattoo LLC remain the intellectual property of the artist. While you receive a permanent tattoo based on the design, the design itself and any preliminary sketches remain our property.

11.2 Photography and Portfolio Use

We may photograph your completed tattoo for portfolio, marketing, and social media purposes. By receiving our services, you grant us permission to photograph and use images of your tattoo (which may include non-identifying portions of your body) for promotional purposes unless you specifically opt out in writing.

We will not use photographs that reveal your face or other identifying features without your express written consent.

11.3 Website Content

All content on our website, including text, graphics, logos, images, and designs, is the property of Matt Vaught Tattoo LLC and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without our written permission.

12. Limitation of Liability

12.1 Assumption of Risk

You acknowledge that tattoos involve inherent risks, including but not limited to:

  • Pain and discomfort during and after the procedure

  • Bleeding, bruising, and swelling

  • Infection (despite proper sterilization and aftercare)

  • Allergic reactions to inks or topical products

  • Scarring or keloid formation

  • Changes to the tattoo over time due to aging, sun exposure, weight changes, or skin conditions

  • Dissatisfaction with the aesthetic result

  • Adverse reactions in MRI machines (some tattoo inks contain metal)

By receiving services, you voluntarily assume these risks.

12.2 Limited Liability

To the maximum extent permitted by law, Matt Vaught Tattoo LLC, its owner, employees, and contractors shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

  • Your use of our services

  • Any injury, complication, or adverse reaction resulting from tattoo services

  • Dissatisfaction with the aesthetic result

  • Improper healing or aftercare

  • Changes to your tattoo over time

  • Any inability to use our website or book appointments

Our total liability for any claim arising from your use of our services shall not exceed the amount you paid for the specific service giving rise to the claim.

12.3 Indemnification

You agree to indemnify, defend, and hold harmless Matt Vaught Tattoo LLC, its owner, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms

  • Your violation of any law or regulation

  • Your provision of false or misleading information

  • Your failure to follow aftercare instructions

  • Any third-party claim related to your use of our services

13. Website Use and Conduct

When using our website, you agree to:

  • Provide accurate, current, and complete information in all forms

  • Not impersonate any person or entity

  • Not use the website for any unlawful purpose

  • Not transmit viruses, malware, or harmful code

  • Not attempt to gain unauthorized access to our systems

  • Not scrape, harvest, or collect information from the website

We reserve the right to terminate your access to our website and services if you violate these terms.

  • Appointment confirmations and reminders

  • Aftercare instructions and healing check-ins

  • Occasional promotional messages about special events, conventions, and guest spots

  • General business updates

  • Two-way communication and customer service

Message frequency varies. Message and data rates may apply. You may opt out at any time by replying "STOP" to any text message.

14.2 Email Communications

By providing your email address, you consent to receive emails for appointment-related communications and occasional marketing messages. You may opt out of marketing emails by clicking "unsubscribe" in any email or contacting us.

15. Privacy

Location-specific details, including setup, parking, and accessibility information, will be provided upon booking.

17. Dispute Resolution and Governing Law

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

17.2 Jurisdiction and Venue

Any legal action or proceeding arising out of or relating to these Terms or your use of our services shall be brought exclusively in the state or federal courts located in Sacramento County, California. You consent to the personal jurisdiction and venue of these courts.

17.3 Informal Dispute Resolution

Before filing any legal action, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. We will work with you in good faith to reach a mutually satisfactory resolution.

17.4 Arbitration (Optional)

If informal dispute resolution is unsuccessful, either party may elect to resolve the dispute through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Sacramento, California.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Matt Vaught Tattoo LLC.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Matt Vaught Tattoo LLC regarding your use of our website and services, and supersede all prior agreements and understandings.

21. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

  • Update the "Last Updated" date at the top of this document

  • Post the revised Terms on our website

  • Notify you via email or text message if changes are material

Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must discontinue using our services.
